Misinformation Drives Suit Against Attorney

In Colorado, prospective clients who did not hire the attorney sued the attorney for negligent misrepresentation because the attorney allegedly misinformed them concerning the statute of limitations in an automobile accident case.  In its opinion, the Colorado Court of Appeals embraced the position taken in the Restatement (Third) of the Law Governing Lawyers that attorneys must use reasonable care in what they say to others when meeting in a professional setting.  The details are available on ABA/BNA Lawyers' Manual on Professional Responsibility.  Read more 25 Law.
