New Ruling Raises Issues of Whether, How
Second Amendment May Be Applied to States
U.S. Law Week analyzes the Second Circuit's recent ruling in Maloney v. Cuomo, 554 F.3d 56, (2d Cir. January 28, 2009), a case that divides observers about whether:
· the Second Circuit properly applied Supreme Court precedent;
· the Supreme Court is likely to grant review;
· the Supreme Court will incorporate the Second Amendment via the due process clause or the privileges and immunities clause; and
